Terms of Use - Novela

These are the terms of use ("Terms") for your use of services or features on the sites owned and controlled by Novela International Pte Ltd ("NOVELA"), including www.novelabeaute.com and NOVELA’s mobile application (the "Sites"). From time to time, additional Sites may be added as we expand our services and offerings and these Terms will govern those new Sites when added.

You may be accessing NOVELA’s Sites via a computer or a mobile phone device (e.g. NOVELA’s mobile application) and these Terms govern your use of our Sites and your conduct, regardless of the means of access.

We may interact with you through third-party platforms such as social media pages (“Social Sites”) like https://www.facebook.com/novelamy/ and https://www.instagram.com/novela.my/ where we publish content and encourage your input. Our Sites dictate the guidelines, rules and regulations associated with our Social Sites. Please note that NOVELA does not govern these Social Sites and these Terms do not apply to organisations that are not owned or governed by NOVELA, or to the conduct of individuals that are not employed by NOVELA. It is advisable that you review the terms of use published on Social Sites.

Please ensure that you have read through these Terms and our Privacy Policy carefully before you access or use our Sites, or purchase any products through our Sites. By accessing or using our Sites, you acknowledge that you have read and agree to these Terms, including our Privacy Policy. If you do not agree to these Terms, please stop using our Sites immediately.

These Terms shall prevail over any other document purporting to have a contractual effect in the event of any inconsistency between these Terms and the terms of any other documents.

NOVELA reserves the right to modify these Terms from time to time if deemed necessary. Should there be changes to these Terms, the new Terms will be posted on this page and will take effect immediately upon posting. It is advisable that you review this page periodically to understand the Terms that apply to your use of our Sites. These Terms are effective as of 2024-07-15.

In these Terms, the following expressions shall have the following definitions:
- "Customer" refers to any individual who is accessing or using NOVELA’s Sites
- "Intellectual Property" refers to all intellectual property rights of whatsoever nature, including (without limitation) patents, designs, present and future trademark or copyright, whether or not registered or registrable by any means, and the right to file an application for registration thereof
- “NOVELA” refers to Novela International Pte Ltd
- “Privacy Policy” refers to the privacy policy dictated on https://www.novelabeaute.com/privacy-policy
- “Sites” refers to Novela’s website (www.novelabeaute.com) and NOVELA’s mobile application
- “Social Sites” refers to third-party social media platforms including but not limited to Facebook and Instagram
- “SST” refers to the sales and service tax imposed on the sale of products in Malaysia
- “Terms” refers to the terms and conditions that govern the use of NOVELA’s Sites

To place an order, you must register for an account with NOVELA through our Sites and provide us with your personal information including but not limited to your name, mobile number, email address, postal address and date of birth.
By registering for an account with NOVELA, you confirm that all personal information provided are accurate and true.
You shall not misuse NOVELA Sites by creating multiple user accounts.
You acknowledge that by creating an account with NOVELA, we may send you promotional or marketing emails, SMSs, and push notifications from time to time.
NOVELA reserves the right to reject the registration of a customer and terminate the registration of a customer at any point in time if deemed necessary.

By placing an order with NOVELA, you acknowledge and agree to be legally bound by the Terms dictated on NOVELA’s Sites.
Prices shown on NOVELA’s Sites are in Malaysian Ringgit (RM) and are inclusive of SST, but do not include any applicable shipping or delivery fees. Delivery fees will be charged if applicable and will be displayed and included in the Order Total upon checkout.
NOVELA is under no obligation to fulfil your order if the prices listed on our Sites are incorrect. We reserve the right to modify product prices and cancel your order if any information on our Sites is found to be inaccurate.

While NOVELA strives to provide accurate details and descriptions for all products listed on our Sites, we cannot guarantee that the information, including descriptions, colours, prices, promotions, and other content found on our Sites is entirely accurate, up-to-date, or without errors. NOVELA reserves the right to rectify any errors, inaccuracies or omissions and to modify product prices and product details at any time without prior notice.
To the extent permitted by law, all warranties, descriptions, representations or advice given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchant-ability or otherwise of the products supplied, are expressly excluded.
You are strongly advised to use products in strict accordance with their usage instructions, precautions and guidelines and check the product ingredient list to avoid potential allergic reactions.
You are strongly advised to consult your health care practitioner regarding the use of any products found on our Sites should you have underlying medical conditions.
No representative of NOVELA is authorised to make any warranties, representations or statements regarding the products available on our Sites and NOVELA shall not in any way be bound by any such unauthorised warranties, representations or statements.

All products displayed on NOVELA’s Sites can be delivered within Malaysia only. NOVELA reserves the right to decline any delivery to addresses that are inaccessible or have restricted access.
The delivery lead time displayed on NOVELA’s Sites are estimates only and NOVELA is not liable for any loss, damage, cost or expense for any failure to meet any given delivery date. If your products have not been delivered within a reasonable timeframe, please do not hesitate to contact us at wecare@novelabeaute.com.
NOVELA reserves the right to reschedule the delivery and charge you a re-delivery fee based on prevailing rates if no one is present to receive the delivery.
If you refuse to accept the delivery, NOVELA reserves the right to cancel your order and charge you for any fee and costs reasonably incurred by us.

The liability of NOVELA whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the products or any other breach of NOVELA obligations hereunder shall not in any event exceed an amount equivalent to the price of the said defective or non-compliant products.
NOVELA shall not be liable for any damages of any kind arising out of or in connection with the use of NOVELA’s Sites. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages and losses of any kind.
NOVELA shall not be liable for any inaccuracy or misstatement of product information and any claims arising out of your incorrect or improper use of products purchased through our Sites.

You agree to defend, indemnify and hold harmless NOVELA (and its directors, officers, employees, consultants, agents, affiliates and third-party service providers) from any and all claims, demands, losses, damages, liabilities, costs, suits and proceedings of every kind, arising from your use of our Sites or your breach of our Terms.

All materials found on NOVELA’s Sites (including but not limited to copyright, trademarks, design rights and all other forms of proprietary rights) are the property of NOVELA, its content providers and/or third-party licensors and are protected by copyright laws. All such rights are reserved. These materials cannot be reproduced, modified, transferred, distributed, republished, downloaded, posted or transmitted in any form or by any means including but not limited to electronic, mechanical photocopying or recording without the prior written permission of NOVELA.
You must not use any materials found on NOVELA’s Sites for commercial purposes without obtaining a license to do so from NOVELA. In the event NOVELA becomes aware of any infringement of its intellectual property rights, we reserve the right to take relevant legal action.

Third-party content may be found on NOVELA’s Sites including but not limited to links to NOVELA’s Social Sites and other third-party websites. These third-party content and websites do not represent NOVELA and are beyond NOVELA’s control. You shall use these third-party content and websites at your own risk and you acknowledge and agree that NOVELA shall not be responsible or held liable for the usage of these third-party content and websites.

NOVELA conducts screening for all received orders to check for fraud or other forms of unauthorised or illegal activity. In cases where there is a suspicion of fraud or unauthorised or illegal activity, we reserve the right to refuse to process the order. NOVELA also reserves the rights to terminate your account or refuse to ship to certain addresses in cases of suspected fraud or unauthorised or illegal activity. Should you find that your account was wrongfully terminated, do not hesitate to contact us at wecare@novelabeaute.com.

NOVELA reserves the right to terminate your account, cancel any orders associated with your account and temporarily or permanently withhold any sales proceeds or refunds with or without notice if deemed necessary.
